Terms & Conditions

1. Scope and Contract Partner

These General Terms and Conditions (T&Cs) apply to all orders placed through the online store of Untamed South Africa (hereinafter referred to as "we", "us", or "the Seller") by customers within Switzerland.

By placing an order, you agree to be bound by these T&Cs. The contract is concluded with Untamed South Africa as soon as you receive our order confirmation email.

2. Products and Prices

  • Product Descriptions: We make every effort to display our South African foodstuffs, meats, and spice blends as accurately as possible. However, actual packaging or product appearances may vary slightly.

  • Pricing: All prices on our website are stated in Swiss Francs (CHF). Shipping costs are calculated and displayed separately at checkout. We reserve the right to alter prices at any time without prior notice; the price listed at the exact time of order completion applies.

  • Availability: Our products (especially seasonal or specialty meat batches) are subject to availability. If an item is out of stock after your order is placed, we will contact you immediately to offer a substitution or a refund.

3. Payment Terms

  • We accept the payment methods specified on the online store (e.g., credit cards, Twint, etc.).

  • Goods remain the sole property of Untamed South Africa until full payment has been successfully processed and received.

4. Shipping and Delivery Conditions

  • Delivery Area: We ship exclusively within Switzerland using the Swiss Post.

  • Perishable Items: Our perishable goods (including frozen meats and biltong) are packed using insulated materials and cooling elements. It is normal and acceptable for frozen items to arrive slightly defrosted.

  • Obligation to Receive: The customer is solely responsible for ensuring that the package can be received or safely dropped off by the Swiss Post upon delivery to prevent food spoilage.

5. Transfer of Risk

  • Crucial Clause: In accordance with Swiss commercial practice, the risk of loss, damage, degradation, or spoilage of the goods passes entirely to the customer the moment the shipment is handed over to the Swiss Post.

  • We are not liable for transit delays caused by the courier, incorrect addresses provided by the customer, or packages left unattended in the elements post-delivery.

6. Warranty and Complaints (Right of Inspection)

  • The customer is required to inspect the delivery immediately upon arrival.

  • Any defects, incorrect items, or delivery errors must be reported to us via email within 24 hours of delivery, accompanied by clear photographic evidence. Failing to report within this timeframe constitutes full acceptance of the delivery.

7. Right of Return and Refunds

  • Perishable Foods: Pursuant to Swiss health and hygiene regulations, all sales of perishable goods (meats, frozen products, fresh foodstuffs) are final. No returns or exchanges are permitted.

  • Non-Perishable Goods: Unopened, sealed, non-perishable goods may be returned within 14 days of receipt at the customer’s own shipping expense, provided the items are in perfect, original retail condition.

8. Data Protection

Your privacy matters to us. The collection and processing of your personal data are governed strictly by our Privacy Policy, which complies with Swiss data protection laws.

9. Liability Limitation

To the maximum extent permitted by Swiss law, Untamed South Africa disclaims all liability for minor negligence, indirect damages, or consequential losses resulting from the use of our website, shipping delays, or the handling of products post-delivery.

10. Governing Law and Jurisdiction

These Terms & Conditions and all contracts formed under them are governed exclusively by Swiss Law. The place of jurisdiction for any disputes arising from this contract is the registered business seat of Untamed South Africa in Switzerland.
